These Terms of Service ("Terms") govern your use of the Baccarator mobile application and the website www.baccarator.com (together, the "Service"). By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Baccarator Is — and Is Not

Baccarator is an educational math tool. It calculates baccarat hand probabilities, expected value (EV), house edge and Kelly-criterion figures from the cards you enter.

Baccarator is not a gambling service. It does not accept wagers, hold funds, pay winnings, or connect to any casino, betting operator or real-money game. Nothing in the Service is betting advice, financial advice, or a recommendation to place any bet.

2. Eligibility

You must be at least 18 years old, or 21 where local law sets a higher age for gambling-related content, to use the Service. By using the Service you confirm that you meet this requirement. The Service is not directed at minors.

3. Your Responsibility for Lawful Use

You are solely responsible for making sure your use of the Service is legal where you are. Many casinos and jurisdictions prohibit the use of electronic devices, calculators or card-tracking aids at gaming tables. Do not use Baccarator anywhere its use is prohibited. We are not responsible for any consequences of using the Service in breach of casino rules or local law.

4. No Guarantee of Results

Baccarat is a game of chance and carries a house edge. Probabilities and EV figures are mathematical estimates based on the information you enter; they depend on accurate card entry and the rules you select, and they cannot predict the outcome of any hand. A positive-EV moment does not guarantee a win. You may lose money in any game you choose to play, and you alone are responsible for your decisions.

If gambling is causing problems for you or someone you know, please seek help from a local support service.

5. Membership and Payments

  • Billing: All purchases are processed by Apple through your Apple ID. We do not receive or store your payment details.

  • Auto-renewal: Memberships renew automatically at the end of each billing period unless you turn off auto-renew at least 24 hours before the period ends.

  • Cancellation: Manage or cancel your membership in your device's Settings → [your name] → Subscriptions. Cancellation takes effect at the end of the current billing period.

  • Refunds: Refund requests are handled by Apple under Apple's policies (reportaproblem.apple.com).

  • Price changes: Prices are shown in the App Store before purchase. Any price change will be notified as required by Apple.

The app is free to download and includes core features. An optional paid membership ("Pro") unlocks additional features.

6. License and Acceptable Use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes, subject to these Terms and the Apple Media Services Terms.

You agree not to: copy, modify, reverse-engineer or resell the Service; bypass membership restrictions; use the Service for any unlawful purpose; or interfere with the Service's operation.

7. Intellectual Property

The Service, including its software, design, text, graphics and blog content, is owned by Dalian Xingzhun Education Technology Co., Ltd. or its licensors and is protected by intellectual-property laws. "Baccarator" and its logo are our trademarks.

8. Privacy

Our Privacy Policy explains what data we collect and how we use it. Data you enter into the app (such as shoe entries and profit/loss tracking) is stored on your device.

9. Third-Party Services

The Service relies on third-party services such as Apple (in-app purchases) and AppsFlyer (install attribution). Your use of those services is subject to their own terms. We are not responsible for third-party services.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages, or for any gambling losses or lost profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim.

Nothing in these Terms limits any rights you have under consumer-protection laws that cannot be excluded by agreement.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms. Sections 4, 7, 10, 11 and 14 survive termination.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will update the effective date above and, where appropriate, be notified in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China (excluding the laws of Hong Kong, Macau and Taiwan). Any dispute arising from or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If it cannot be resolved within 30 days, it shall be submitted to the China International Economic and Trade Arbitration Commission (CIETAC) for arbitration in accordance with its rules in effect at the time of application. The arbitral award is final and binding on both parties.

15. Apple-Specific Terms

If you downloaded the app from the Apple App Store:

  • These Terms are between you and us, not Apple. Apple is not responsible for the app or its content.

  • Apple has no obligation to provide maintenance or support for the app.

  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.

  • Apple is not responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to meet legal or regulatory requirements, or consumer-protection claims.

  • Apple is not responsible for investigating or defending any third-party claim that the app infringes intellectual-property rights.

  • You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
